These Terms of Service ("ToS") govern the sale of motorsport photographs ("Images") by Photonic Note (Jon Harnden) to private vehicle owners ("Buyer"). By purchasing an Image, the Buyer agrees to these terms.

At Photonic Note, we specialize in capturing high-quality motorsport photography, and our goal is to provide private vehicle owners with exclusive images of their vehicles in action. Due to the presence of sponsors and company logos in motorsports, selling images publicly can present copyright challenges. To respect intellectual property rights and maintain compliance with licensing agreements, we limit sales to private owners, ensuring they can enjoy their images without legal complications.

1. Purchase Eligibility

The sale of Images is strictly limited to private vehicle owners. The Photographer reserves the right to request proof of ownership before completing a sale.

2. Usage Rights & License

The Buyer is granted a non-exclusive, non-transferable license for personal use only. The Images may not be resold, commercially distributed, or used for promotional purposes without written consent from the Photographer.

3. Ownership & Copyright

All Images remain the intellectual property of the Photographer. The purchase of an Image does not transfer copyright ownership. The Photographer retains the right to use, reproduce, and distribute the Images unless a separate agreement is made.

4. Watermark & Editing Restrictions

Buyers may not remove or alter watermarks, logos, or metadata embedded in the Images. Cropping, retouching, or any modification that misrepresents the original work is prohibited.

5. Delivery & Fulfillment

Images will be delivered digitally or as physical prints based on the selected option at checkout. Delivery timelines may vary, and the Photographer is not responsible for delays due to technical or logistical reasons.

6. Refund & Dispute Policy

All sales are final. Refunds are only issued in cases of incorrect or defective delivery. Disputes must be submitted in writing within 7 days of purchase for resolution.

7. Liability & Indemnification

The Photographer is not responsible for any misuse of the Images by the Buyer. The Buyer agrees to indemnify and hold harmless the Photographer from any legal claims arising from improper use.

8. Legal Jurisdiction

These Terms shall be governed by the laws of Texas. Any disputes will be settled in the appropriate courts of that jurisdiction.
